Benjamin Rush writes, to Rev. Mr. [William] Gordon, at Roxbury, Mass., December 10, 1778:

Dear Sir.

It gave me great pleasure to find from your last letter that your feelings & Opinions accord so exactly with mine on the present state of our Affairs. The time is now past, when the least danger is to be apprehended to our liberties from the power of Britain, the Arts of commissioners, or the machinations of Tories [British loyalists]. Tyranny can now enter our country only in the shape of a Whig [American Patriots]. All our jealousy Should be of ourselves. All our fears, Should be of our great men, whether in civil or military authority. Our Congress begin already to talk of the State Necessity, and of making justice yield in some cases to policy. This was the apology, I was told, for confirming the unjust Sentence that was passed upon General [Charles] Lee. Gordon tells us that in England, the Whigs in power are always Tories, and the Tories out of power are always Whigs. I think I have discovered Something of the same kind already in our country. In my opinion, we have more to dread from the Ambition, avarice, craft & dissolute Manners of our Whigs than we have from a host of Governor [George] Robinsons, Dr [John] Berkenhouts, [Thomas] Hutchinsons or [Joseph] Galloways. Virtue, Virtue, alone my dear friend, is the basis of a republic. “Fiat justitia, ruat coelum,” [Translation: “Let justice be done, though the heavens should fall“] was my maxim during the short time I acted for the public. I had no political Ambition to gratify. I neither feared nor courted any party. I loved liberty for its own Sake, & I both loved & pitied human nature too much to flatter it. But what was the consequence? my political race was Short. I thank my countrymen for dismissing me from their Service. I want no Offices nor honors from them. My temper & my business render me alike independent of the world. But still I will love them, & watch for their happiness. I long to see the image of God restored to the human mind. I long to see Virtue & religion supported & vice & irreligion banished from Society by wise & equitable governments. I long to see an Asylum prepared for the persecuted & oppressed of all countries, & a door opened for the progress of knowledge, literature, the Arts, & the Gospel of Jesus Christ, to the ends of the earth. And these great events are only to be accomplished by establishing & perpetuating liberty in our country. O! best of blessings! Who would not follow thee blindfold? Who would not defend thee from the treachery of friends as well as from the malice of enemies? But I must stop. When liberty, the liberty we loved, and contended for in the years 1774 & 1776 is my Subject, I know not where to begin, nor where to end. 0! come celestial stranger & dwell in this our land. Let not our ignorance, our Venality, our luxury, our idolatry to individuals, & our Other anti-republican Vices, provoke thee to forsake the temple our Ancestors prepared for thee. Put us not off with Great Britain’s acknowledging our independence. Alas! the great Ultimatum of our modern patriots. It is liberty alone that can make us happy. And without it the memorable 4th of July 1776, will be execrated by posterity as the day in which Pandora’s box was opened in this country.

I am impatient to see your history. How many Chapters or Volumes have you allotted for the blunders of our Congress, & generals? Weak minds begin already to ascribe our deliverance to them. Had not heaven defeated their counsels in a thousand instances, we should have been hewers of wood & drawers of water to the Subjects of the king of Britain.

Philadelphia, December 23, 1791.

Dear Sir,—I received duly your favor of October 22, and should have answered it by the gentleman who delivered it, but that he left town before I knew of it.

That it is really important to provide a constitution for our State cannot be doubted: as little can it be doubted that the ordinance called by that name has important defects. But before we attempt it, we should endeavor to be as certain as is practicable that in the attempt we should not make bad worse. I have understood that Mr. Henry has always been opposed to this undertaking; and I confess that I consider his talents and influence such as that, were it decided that we should call a convention for the purpose of amending, I should fear he might induce that convention either to fix the thing as at present, or change it for the worse. Would it not therefore be well that means should be adopted for coming at his ideas of the changes he would agree to, and for communicating to him those which we should propose? Perhaps he might find ours not so distant from his, but that some mutual sacrifices might bring them together.

I shall hazard my own ideas to you as hastily as my business obliges me. I wish to preserve the line drawn by the federal constitution between the general [Federal] and particular [State] governments as it stands at present, and to take every prudent means of preventing either from stepping over it. Though the experiment has not yet had a long enough course to show us from which quarter encroachments are most to be feared, yet it is easy to foresee, from the nature of things, that the encroachments of the State governments will tend to an excess of liberty which will correct itself, (as in the late instance,) while those of the general government will tend to monarchy, which will fortify itself from day to day, instead of working its own cure, as all experience shows. I would rather be exposed to the inconveniences attending too much liberty, than those attending too small a degree of it . Then it is important to strengthen the State governments; and as this cannot be done by any change in the federal constitution, (for the preservation of that is all we need contend for,) it must be done by the States themselves, erecting such barriers at the constitutional line as cannot be surmounted either by themselves or by the general government. The only barrier in their power is a wise government. A weak one will lose ground in every contest. To obtain a wise and an able government, I consider the following changes as important. Render the legislature a desirable station by lessening the number of representatives (say to 100) and lengthening somewhat their term, and proportion them equally among the electors. Adopt also a better mode of appointing senators. Render the Executive a more desirable post to men of abilities by making it more independent of the legislature. To wit, let him be chosen by other electors, for a longer time, and ineligible forever after. Responsibility is a tremendous engine in a free government. Let him feel the whole weight of it then, by taking away the shelter of his executive council. Experience both ways has already established the superiority of this measure. Render the judiciary respectable by every possible means, to wit, firm tenure in office, competent salaries, and reduction of their numbers. Men of high learning and abilities are few in every country; and by taking in those who are not so, the able part of the body have their hands tied by the unable. This branch of the government will have the weight of the conflict on their hands, because they will be the last appeal of reason. These are my general ideas of amendments; but, preserving the ends, I should be flexible and conciliatory as to the means. You ask whether Mr. Madison and myself could attend on a convention which should be called? Mr. Madison’s engagements as a member of Congress will probably be from October to March or April in every year. Mine are constant while I hold my office, and my attendance would be very unimportant. Were it otherwise, my office should not stand in the way of it. I am, with great and sincere esteem, dear Sir, your friend and servant.

VA Scandal Whistle Blower Reveals How Government Bureaucrats Empire Build & Grow Fiefdoms

In an interview with Neal Cavuto: Whistle Blower Scott Davis Who at the request of the VA [Veterans Administration] office of Inspector General to confirm rumors or activity at the VA Health Eligibility Center (HEC) in Atlanta dealing with the destruction of 17,000 applications for VA healthcare. Davis Reveals the Big story is the Back Log of Over 600,000 Individual applications for VA Health Care as well as the 17,000 Health Benefit Applications Were Deliberately Destroyed by VA Union Employee Members. Davis adds “That’s shameful.” I agree!

When asked by Neal why the VA HEC would destroy the applications. Davis also Reveals White House Pressure For VA HEC to hit their numbers, you’ve heard a lot about the 14 day turn-around time for the hospitals, but what most people don’t know is, there’s a 5 day turn-around time for applications and if we don’t hit that 5 day turn-around time it effects performance goals for people in senoir leadership positions. Davis went on to say. “What happens is that we’re currently neglecting not only the right thing to do which is to process applications. Not delete them, we have a huge system integrity issue at VA. For example, the VA right now can’t even tell investigators what happened to those applications, because they can’t verify where they are, what happened to them, if they were deleted, why were they deleted and why were there was no paper record showing the justification for deleting those records.”

Neal said “We’ve asked for a statement from the VA on this, we’ve yet to get one…I’m trying to give them the benefit of the doubt here.” Neal went on to ask if the workers just got overwhelmed and dumped the applications in the trash. Davis responded: “I know there were suspect activities before I started working there in 2011, what I can tell you is there is so much pressure on the employees to get stuff done, so that management can meet goals…So what happens is instead of VA focusing on doing what’s right for our nations veterans, meaning taking time, processing each application diligently and appropriately, pressure is placed on front line employees to overwork themselves, rush through the application process to hit goals for members of management.”

Neal asked Davis if the goal was a dollar goal or to get the applications complete. Like to keep on top of it to make sure there were no delays or Keep on top of it and get rid of something that could hurt our numbers. Davis responded from what he had seen “it is based on a performance goal…What you find is there is extensive pressure placed on the staff…to focus our attention to applications that are based on specific campaigns coming out of Washington. For example; We actually put applications aside so we could focus on the ACA [Obamacare] applications that came in last summer. That’s wrong, we should focus on each veterans application as they come in, not because of special campaigns coming out of [Washington] D.C.”

When Neal remarked about the protections provided by federal law to whistle blowers.
Davis said also “I reached out to White House Deputy Chief of Staff Rob Nabors [one of Obama’s top advisers, who Obama put over analyzing VA problems] to share my concerns about the VA and to give Nabors a copy of my Whistle Blower Complaints. Somehow that correspondence & complaint was given to the very same management group at the HEC who was harassing me. Davis added: “I received an email from my current manager Sherry Williams saying ‘I’m contacting you on behalf of acting Secretary Gibson and Rob Nabors.’ I let the White House, Mr. Nabors, and Acting Secretary Gibson know this had happened. To this date they have taken No Action against Miss Williams.”

Davis went on to say “I contacted the Inspector General to let them know what Miss Williams had done, and keep in mind Miss Williams used to work for the Inspector General. Which makes it even more shameful. I was told by the Office that was Investigating the HEC, They could not address the issue that I had to call a Hot Line. When I called the Hot Line, the Hot Line told me to call the Office of Special Counsel. Now I did get a contact from the White House Counsel’s Office or [White House] Office of Special Counsel,.. and I use that name,.. and I contacted that Person to file a complaint. But, I want to be honest…The only reason I haven’t been fired today is because I have been working with Chairman Miller’s Team [Chairman Jeff Miller. House Committee on Veterans’ Affairs] as well as my Congressmen Tom Price and Senator Johnny Isaacson. If I did not have elected Officials working with me to address these issues, I would have easily been terminated a long time ago. Especially I would have to thank the team over at AJC [Atlanta Journal Constitution] that broke the article this weekend.”

Neal says “it seems the VA going years back, is overwhelmed and cannot handle the workload”
Whistle Blower Davis responded “I think if you allow the employees and the people who go to work everyday to service our nations veterans, the work will get done, the money is there, it’s over 160 Billion dollars in the [Federal] Budget. But you brought up a key point Neal, and that is, this goes back years, and that’s because the leaders in the VA, in particular VHA, the healthcare side have been in leadership at VA in many cases, some before I was even born at the start of their career at the VA”

Neal said it seemed like the lifelong bureaucrats at the VA seemed to jump through hoops in order to get those bonuses and make the numbers.” Scott Davis responded “I think a lot of managers did it to make the numbers to get the bonus, but also look at the influence of government. People in government don’t just do what they do for their bonuses….They also do it to Empire Build. The more you hit your numbers the more you can expand your department, you can expand your Fiefdom at VA as I like to call it. So for example in our department where we work. We brought in about 4 or 5 new GS-15 Positions. These are 130-150 thousand dollar a year positions, yet we haven’t done anything to bring in workers who can actually bring down the workload. That’s what a veteran wants. He or she wants their healthcare application processed, they don’t need another executive to stand around looking at other people doing the work.”

Neal asked, if there was any metric or was there some sort of quality [assurance] ..something like JD Power type award, or recognition, or bonus for behavior that would make things better for Vets?

Davis reveals: “I can tell you from the whistle blowers I have talked too, that work at VHA. Their account is, it was the Bonus Structure was more about Rewarding the Executives, and it Incentivised not fully disclosing Medical Needs of the Veterans. For example if people in Congress knew that veterans needed more medical care, they probably would have given us more money to send vets to mental health professionals, to send people to specialty care physicians. If you don’t disclose that information the veterans don’t get the monies they need for the care they deserve and have earned.”
